Pursuant to Chapter 30B, Section 15 of the Massachusetts General Laws (M.G.L. c. 30B, §15), the Town of Natick, Natick Town Hall, 13 East Central Street, Natick, MA 01760 (“the Town”) invites the submission of bids in an online auction to dispose of the following surplus item:

Said item will be listed as item no. 3360739 on the website www.publicsurplus.com . Said item will begin on September 22, 2023, at 11:11 A.M. EDST, and will end on November 7, 2023, at 3:00 P.M. EST.

Bids may NOT be placed directly with the Town, but must be processed through the auction website.

The item will be sold, if at all, to the responsive bidder offering the highest price for the item described in this notice and on the auction site listing. The Town of Natick reserves the right to reject any and all bids and to dispose of the item through a negotiated sale, provided that the negotiated sale price is higher than the highest bid received from a responsive bidder.

Note that the estimate of this auction is less than $10,000. However, if the bidding exceeds $10,000 at any point, the Town shall be required to cancel, advertise this auction under M.G.L. c. 30B, sec. 15, and repost the auction. Alternatively, it may extend the auction to allow for full advertising under said sec. 15.

Upon winning the auction, the winning bidder shall be required to submit a signed non-collusion form to the Town of Natick prior receipt of the item. Said non-collusion form shall state as follows:

“The undersigned certifies, under penalties of perjury, that its Bid has been made and submitted in good faith and without collusion or fraud with any other person. As used in this certification, the word “person” shall mean any natural person, business, partnership, corporation, union, committee, club or other organization, entity, or group of individuals.”

The winning bidder shall also certify that, pursuant to M.G.L. c. 62C, §49A, that it is in compliance with all laws of the Commonwealth of Massachusetts pertaining to taxes, to the reporting of employees and contractors, and to the withholding and remittance of child support.

Payment in full, in the form of electronic payment to publicsurplus.com is required prior to pickup. It shall be the seller’s responsibility to pick up all goods in person, within ten (10) days, from Natick DPW, after payment is made in full. Delivery of goods is buyer’s responsibility. Goods shall be sold as is, where is. Seller disclaims any and all warranties, including those of merchantability and fitness for particular purpose.
